Acceptance and electronic record

Account creation is conditional on affirmative acceptance of the current Terms. The service records the accepted Terms version, acceptance date and the user account connected to that acceptance. Selecting Accept Terms & Conditions has the same effect as an electronic signature to the extent permitted by applicable law. The Cookie Policy acknowledgement is separate and is not a condition of account creation.

These Terms form a binding agreement between the user and the operator of Beyond The Visa (“BTV”, “we”, “us”). By ticking the acceptance box and creating an account, the user confirms that they have read and agree to these Terms and the Privacy Policy. A person who does not agree must not create an account or use the service.

1. Eligibility and accounts

The service is intended for adults aged 18 or over. Users must provide accurate information, keep credentials confidential, use one personal account unless authorised otherwise and promptly report suspected misuse. Users are responsible for activity through their account except to the extent caused by our breach of law.

2. Service scope

BTV provides general education, planning, relocation and career-preparation tools for nurses and midwives. Features may include checklists, articles, calculators, question banks, mock tests, AI-assisted explanations, community areas, external links, bookings and paid services. Features and availability may change.

3. CBT and NCLEX preparation disclaimer

BTV questions and mock tests are independently created practice materials designed to reflect the style, format, subject areas, clinical reasoning and expected standard commonly associated with CBT and NCLEX preparation. They are not actual, copied, leaked, recalled or guaranteed examination questions and do not predict any examination. BTV is not endorsed by, affiliated with or approved by the NMC, NCSBN, Pearson VUE or any examination body. “NCLEX” and other third-party names and marks belong to their respective owners. Users must consult the current official test plan, handbook and regulator guidance.

4. No professional advice or guaranteed outcome

Content is general information, not patient-specific clinical instruction, medical diagnosis, legal or immigration advice, financial or tax advice, recruitment advice or an emergency service. Nothing guarantees exam success, registration, employment, sponsorship, a visa, settlement or any other outcome. Users remain responsible for decisions and must verify current requirements with the relevant regulator, government, employer or appropriately qualified adviser and follow local clinical policy.

5. Educational and AI limitations

Educational, generated and AI-assisted content may be incomplete, outdated or incorrect. It must not replace professional judgement, supervised training, authoritative sources or emergency procedures. Users must never enter identifiable patient data, special-category health data, payment-card data, passwords, government identifiers or confidential employer information into learning, AI, community or support fields.

6. Acceptable use

Users must not break the law; impersonate others; harass, discriminate, defame or deceive; upload malware; probe security; disrupt the service; bypass access controls; scrape or systematically extract content; reverse engineer except where law expressly permits; share paid access; facilitate exam misconduct; submit leaked or recalled exam content; infringe rights; or use BTV to provide regulated services without authorisation.

7. Intellectual property and limited licence

BTV and its original text, question banks, mock tests, explanations, designs, software, branding and compilations are owned by or licensed to the operator and protected by applicable intellectual-property laws. Users receive a personal, limited, revocable, non-exclusive, non-transferable licence for their own study and planning. Sale, publication, redistribution, commercial training use, database creation or derivative question banks require written consent.

8. User content and community

Users retain ownership of content they submit and confirm they have the necessary rights. They grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, format, display and moderate it only as needed to operate, secure and improve the relevant service feature, subject to the Privacy Policy. Community views are those of users, not BTV. We may remove content and preserve or disclose information where reasonably required for safety, enforcement or law.

9. Privacy and security

Personal data is handled as described in the Privacy Policy. Users acknowledge that no online service is completely secure and must use reasonable safeguards. Profile photos and account data may be stored by contracted infrastructure providers to enable cross-device access.

10. Third-party services

External regulators, governments, employers, job sites, payment providers and linked services are independently controlled. A link does not amount to endorsement or a guarantee of accuracy, availability, sponsorship or safety. Their terms and privacy notices apply. Users must verify employers and must not pay anyone for a guaranteed job, visa or exam result.

11. Paid services, renewals and cancellation

Prices, currency, included features, renewal frequency and material restrictions will be shown before purchase. Premium may renew until cancelled. Cancellation stops future renewal and access normally continues to the end of the paid period. Coaching and CV services are separate purchases. Statutory cancellation and refund rights are unaffected; otherwise refunds are governed by the terms shown at checkout.

12. Availability and updates

We may maintain, update, suspend, restrict or discontinue all or part of the service for security, legal, operational or commercial reasons. We do not promise uninterrupted, error-free or permanently available operation. Users should retain their own copies of important documents and must not rely on BTV as their only record.

13. Suspension and termination

Users may stop using the service at any time. We may restrict or terminate access where reasonably necessary for a material or repeated breach, security risk, non-payment, harm to others, unlawful conduct or legal requirement. Where appropriate, we will give notice and an opportunity to remedy. Terms intended to survive termination continue to apply.

14. Disclaimers

To the fullest extent permitted by law, the service is provided “as is” and “as available”. We do not make warranties about completeness, accuracy, fitness for a particular purpose, non-infringement or results. Nothing limits mandatory consumer guarantees or rights that cannot legally be excluded.

15. Limitation of liability

Nothing excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or liability that cannot lawfully be excluded. Subject to that, and to the fullest extent permitted by law, we are not liable for indirect or consequential loss, lost profits, lost opportunity, examination failure, regulatory or immigration decisions, third-party conduct or loss caused by reliance on unverified content. Any financial cap must be completed by the operator and reviewed for the governing jurisdiction before commercial launch.

16. Indemnity

To the extent permitted by law, a user is responsible for losses and reasonable costs arising from their unlawful use, infringement of another person’s rights, prohibited exam-content submission or material breach. This does not require a consumer to compensate us for loss caused by our own breach or negligence.

17. Changes to these Terms

We may update these Terms for legal, security or service changes. Material changes will be dated and presented before they take effect where required. Continued use after valid notice constitutes acceptance only where permitted by law; otherwise fresh consent will be requested.

18. General legal terms

If any provision is unenforceable, the remainder continues. Delay in enforcement is not a waiver. Users may not transfer this agreement without consent; we may transfer it in a lawful business reorganisation provided user rights are not reduced. These Terms, the Privacy Policy and purchase-specific terms form the entire agreement for the service.

19. Governing law, disputes and contact

Launch requirement: the operator must insert its full legal name, registration number if applicable, address, monitored email, governing law, courts and mandatory consumer-dispute information before commercial launch. Nothing removes a consumer’s mandatory rights in their country of residence. Questions can currently be submitted through Contact Us.
